Spark Driver™ Privacy Statement

Notice of Changes: In this update, we clarified what personal information we collect, how we use it, and to whom we disclose the personal information.
In particular:
· We added “inferences” as a category of personal information we may collect. Inferences are personal information drawn from other personal information we collect that may indicate information about you, such as your preferences and characteristics. For example, we may use information about past delivery offers accepted to better match drivers with offers. Inferences help us improve the Spark Driver program, app, and our business operations.
· We added “driver information” as a new category of personal information to better describe the information we previously listed under other categories, such as personal identifiers, government identifiers, and background information. We also added “profile photo” to this category.
· We use a vendor to collect and process biometric information for identity verification and fraud prevention purposes (which may be considered a disclosure of your personal information). We’ve clarified that we may use additional vendors to provide the same services in the future.
· We added a table to make it easier to understand the types of personal information we disclose to various types of third parties. We also clarified that we disclose biometric information (our vendor collects such information as noted above) and driver information.

This Spark Driver™ App Services Privacy Statement (hereinafter referred to as “Privacy Statement”) applies to information that is collected from independent contractors and prospective independent contractors through the use of this Website, the Spark Driver App, and any other interactions with the Spark Driver Program. This Privacy Statement describes what personal information we collect, how we collect and use your personal information, who we disclose it to and why, the measures we take to protect your personal information, and the choices you may have regarding our use of your personal information in relation to the Spark Driver Program including your use of the Spark Driver App.
What is Not Covered in this Privacy Statement?
Customer information (the information of those for whom you perform Services using the Spark Driver App) is subject to the Walmart Customer Privacy Notice.
The Walmart Customer Privacy Notice describes the collection, use, disclosure of and Walmart’s privacy practices related to your information on store premises and in-store technologies. For example, the Walmart Customer Privacy Notice describes the collection, use and disclosure of information gathered through in-store cameras and automated license plate readers in store parking lots. In some cases, we may use additional in-store technology for the Spark Driver program. Such additional in-store technology will be described below and used consistently with this Privacy Statement.
What Personal Information Do We Collect?
We may collect or receive (and may have collected or received during the 12-month period prior to the Last Updated date of this Privacy Statement) the categories of personal information listed below. Not all categories will be collected or received for every individual.
We use information above that may be considered Sensitive Personal Information under some state laws for each of the purposes described below and to make inferences about you, for example to improve the Spark Driver Program and App and detect and prevent fraud. Where required by law, Walmart only processes this Sensitive Personal Information with your consent. Sensitive Personal Information includes precise geolocation and biometric information and may include some sensory information, some government identifiers (such as SSN and driver’s license), financial account information, background information, and any communications where Walmart is not a party.

We may obtain and combine personal information from different sources, types of technology, and devices.

Collected Through Automated Means
You also provide us the categories of personal information listed above in this What Personal Information Do We Collect section in other ways through technology, such as when you use our websites and applications. Some of this information may be linked to you personally. This information helps us effectively partner with you and conduct our business. This information can include device information and identifiers, and other online identifiers; Internet, Network Activity Information, and Other Device and App Usage Information; sensor information; and geolocation information.
Depending on your device’s settings, we may collect precise geolocation information. You can control our ability to do this by adjusting the location-sharing settings on your mobile device at any time.
In addition to the above, and with your consent, we use your device’s camera to collect personal information. You must give us your permission before we access these features, and you can opt out of providing access to them at any time by adjusting the settings on your device.
Collected Through In-Store and Facilities Technology
We may collect your personal information from technology we use in our stores and other facilities, such as our facility cameras. We may also implement ID verification systems in-store. We may collect basic identifiers, photo, video, internet and network activity or other usage information.
Collected From External Third-Party Sources
As part of our standard driver onboarding process, we may receive information from third party sources, such as background information and criminal convictions to help us assess driver suitability, reduce fraud, and ensure an effective partnership with you. In some cases, you may verify your identity through a separate technology provider, who may share information with us with your consent.
We may receive information collected by service providers on our behalf. For example, we use a third-party service provider to perform biometric identity verification and fraud prevention on our behalf. We receive information about you, such as government identifiers and photographs collected by our service providers.
Our corporate affiliates may also provide us with the personal information described above to prevent fraud and ensure the integrity and security of our business, the Spark Driver Program, and the Spark Driver App.
Collected from Publicly Available Sources
We may also collect publicly available information from social media companies (which may include personal information) to understand conversations, trends, and other issues relating to the Spark Driver program.
How Do We Use Personal Information?
We use the categories of personal information above to provide you with services within the Spark Driver Program and use of the Spark Driver App and to operate and improve our business. For example, we use it for:
In some cases, these functions are carried out by automated technology. For example, automated technologies may use information about past choices, location, customer ratings, and demand in your area to order the offers presented to you and improve the efficiency and operations of our business.
To the extent we process deidentified information, we will maintain and use the information in deidentified form and will not attempt to reidentify the information unless permitted by applicable law.
Who Do We Disclose to & Why?
We may disclose all categories of personal information described above to certain categories of third parties, as described below. Some states provide rights to opt out of certain disclosures considered to be “sales” or “sharing” (i.e., disclosures for cross-context behavioral advertising) of personal information. As described further below, we do not engage in sales or sharing of personal information collected under this privacy statement.
To Customers
We may disclose some of your personal information, such as profile photo and name, to customers receiving deliveries to facilitate the delivery and to assist the customer in anticipating and identifying the delivery and for security purposes. We may also disclose Claims Information and related personal information to customers in the event of claim. If a customer signs up for delivery updates, we may also communicate the estimated delivery time and the location of their delivery. Further, customers will receive communications you send via our chat features.
Within Our Corporate Family of Companies
We may disclose your personal information with other retail and non-retail companies (e.g., Sam’s Club) within our corporate family for them to use in ways that are consistent with this Privacy Statement. With your consent, such as when establishing an earnings account, we may share your information with One Finance or related financial institutions.
Other Companies
We may disclose personal information to the entities listed below, for the reasons described. In circumstances other than those described below, in accordance with applicable law, we will provide specific notice or ask for your affirmative consent.
Vendors for Business Operations: We disclose personal information about you to vendors to perform services on our behalf. These vendors include without limitation:

· Companies that help us operate and improve our products and services;
· Companies that manage insurance claims, comply with our legal obligations, or provide other administrative services; and
· Identity verification vendors such as Persona, which process personal information including biometric information, such as facial geometry, and government identifiers to verify identities and help us prevent fraud and safeguard the Spark Driver Program and to comply with our legal functions or obligations.

We may disclose your personal information when required by law or legal process. Sale or Share of Personal Information of Consumers under 16 Years of Age
We do not knowingly sell or share (for cross-context behavioral advertising) the personal information of consumers under 16 years of age.
Disclosing Personal Information for Business Purposes
During the 12-month period prior to the Last Updated date of this Spark Driver Privacy Statement, we may have disclosed the above-categories of personal information with third parties, as described above, for a business purpose. We require our service providers to keep your personal information secure, and do not allow our service providers to use or share your personal information for any purpose other than providing services on our behalf. We may share your personal information in other special circumstances, which include situations when sharing is required by law, or we believe sharing will help to protect the safety, property, or rights of Walmart, our customers, our associates, or other persons.
Third Party Links
The Spark Driver Program may allow you access to links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or disclose personal information about you. We may not own or control these linked online services or third-party features, and we are not responsible for the information practices of the third parties that have ownership or control over them. In some cases, these third parties operate independently from us, which means their privacy practices are not covered in this Privacy Statement. We recommend that you review their privacy statements to learn about these third parties' privacy practices, including details on the personal information they may collect about you.
How Long Do We Retain Your Personal Information?
We will keep the personal information we collect about you for as long as necessary to carry out the purposes set forth in this Privacy Statement or any other notice provided at the time of data collection, but no longer than as required or permitted under applicable law or internal policy. We dispose of the information we collect in accordance with our retention policies and procedures.
Biometric Retention Schedule: For Illinois residents, as applicable, we will permanently destroy your biometric identifiers and biometric information when the first of the following occurs: (i) the initial purpose for collecting or obtaining such biometric data has been satisfied; or (ii) within 3 years of your last interaction with us.

How Do We Secure Your Personal Information?
We use information security measures, including physical, administrative, and technical safeguards to reasonably secure your personal information. How Does Spark Driver Protect the Privacy of Children Online?
Spark Driver™ App Services is a general audience website intended for business-to-business use and not directed at children under the age of 13.
Please contact us if you have concerns regarding the potential collection of your child’s information.
California Privacy Rights
If you are a California resident, you can make certain requests regarding your personal information, and we will fulfill each request to the extent required by law. If we are unable to comply with your request in whole or in part, we will notify you with reasons for the denial. We do not offer the option for you to request we stop selling your personal information or sharing it for cross-context behavioral advertising because we do not conduct such selling or sharing of your personal information.

You may exercise any of these privacy rights by going to the footer of our website or settings section of our app and selecting the “Your Privacy Choices” link, or call 1-800-Walmart (1-800-925-6278), press one, and say “Privacy”.

To access your personal information, click “Your Privacy Choices." Requests to access your personal information may be submitted up to two times in a rolling twelve-month period. Once we receive a request, we will delete the personal information (to the extent required by law) we hold about you as of the date of your request from our records and direct our service providers to do the same. 3. Correct My Personal Information: You have the right to ask that we correct the personal information we may have collected about you if that information is inaccurate. 4. Limit the Use and Disclosure of Sensitive Personal Information (SPI): You have the right to ask that we limit our use and disclosure of your SPI to certain purposes permitted by law and can do so by clicking “Your Privacy Choices.”
We will not discriminate against you for exercising your rights. We will not deny you goods or services, charge different prices or rates, provide a different level of service or quality of goods, or suggest that you might receive a different price or level of quality for goods. Some programs or membership services require usage of personal information to function, so compliance with your request may impact those experiences.
How Do We Verify Your Identity to Complete Your Access, Correction and Deletion Requests:

Third-party identification services may help us with verification to prevent disclosure of your personal information resulting from fraudulent requests. What If You Cannot Verify My Identity?
If we cannot verify your identity, we will notify you, and your request(s) to access, request, or delete your personal information may not be processed. Any requests may be denied if we have reason to believe they are fraudulent.
How Do I Submit a Request Using an Authorized Agent?
If you would like an authorized agent to exercise your rights for you, they may use the same links described above to submit requests. We require documentation demonstrating your agent’s authority to submit requests on your behalf. For example, a valid power of attorney or other documentation, including a letter, signed by you (the California resident) authorizing the agent to submit your requests.
